This User Agreement ("Agreement") governs your use of products, services, mobile applications, and associated functionalities provided by GET SWOOP'D! LLC ("GET SWOOP'D!", "Company", "we", "our", or "us"). By accessing or using our Services, you ("User", "you", "your") agree to this Agreement entirely.
Users under 18 years of age may use Services only with explicit written consent and direct supervision from a parent/legal guardian. The parent/legal guardian must create and verify the account using personal identification and payment methods (credit card), accepting full legal responsibility for the minor’s actions and liabilities arising from Service use.
You must verify your account via:
Maintain accurate details and promptly inform us of changes.
By registering, you consent to receive electronic notifications regarding rentals, including alerts for rental expiration and options to extend your rental through SMS, email, or in-app notifications. Preferences can be updated anytime via your user profile.
You expressly agree NOT to:
Violations result in full liability for all damages.
Scooter riding includes inherent risks (collision, mechanical failure, theft, weather hazards). You voluntarily assume all risks and waive claims against GET SWOOP'D! and Released Parties for accidents, injury, emotional distress, loss of income, reputational harm, or property damage.
You indemnify Released Parties against claims, liabilities, costs, damages, or fees arising from your Service use, including accidents, injuries, unauthorized third-party use, and violations of applicable laws or this Agreement.
Immediately use in-app or website "Roadside Assistance" to report accidents, malfunctions, theft, or emergencies within 2 hours, and file a police report within 24 hours for serious incidents.
You acknowledge adherence to our Privacy Policy, available at www.swoopdscooters.com/privacy.
You explicitly consent to:
Data may be shared with law enforcement upon valid request.
All trademarks, logos, software, scooter technology, and trade secrets associated with GET SWOOP'D! are our exclusive property. Unauthorized reproduction or use is strictly prohibited.
Submitting content grants GET SWOOP'D! unrestricted rights for use and distribution. We encourage social media interaction (Snapchat, Instagram, TikTok, Facebook), including promotional campaigns offering discounts.
Currently, GET SWOOP'D! does not offer special accommodations or adaptive scooters but plans to in the future. Users must assess their own capability to safely operate scooters.
Payments processed through third-party processors (Stripe) are subject to additional terms. Refund requests must be submitted within 24 hours of disputed transactions, granted at our discretion.
All disputes shall be resolved through binding arbitration under laws of Washington State, Chelan County, Chelan 98816, conducted by the American Arbitration Association (AAA).
Neither party is liable for delays or failures due to circumstances beyond reasonable control (natural disasters, pandemics, civil unrest).
This Agreement is governed exclusively by the laws of Washington State, Chelan County.
If any provision is unenforceable, the remainder remains effective. This document represents the full agreement, superseding prior agreements.
